Theft is typically a misdemeanor, but it can be charged as a felony if the value of stolen goods or services exceeds $300. Burglary is often charged as a felony, especially if there was forcible entry or there were people inside the structure at the time. Any robbery is usually a felony, but using a weapon or bringing a gun to the scene of the crime can escalate the presumptive prison sentence to 10 years or more.
